A 71-year-old woman from Richland Hills, Texas, has been arrested and charged for a hate crime for assaulting a 25-year-old man with her wooden cane because she believed he is gay and has AIDS, the Star-Telegram reported.

Richland Hills is in North Central Texas and about 37 miles west of Dallas.

Police say Wanda Derby beat Lloyd Guerrero, her neighbor and her son’s roommate, with her cane and choked him because she believes he is gay.

"As I lifted up my arm, when I saw her, she just hit me right here," Guerrero told the Houston news station KHOU. "She was hitting and screaming and hitting and screaming and hitting and screaming," he added.

Derby found out that her son was planning to move in with Guerrero and police say that’s what ignited Derby’s rage.

Guerrero, who is an aspiring actor, claims that Derby had been posting derogatory comments about him and his family last month on her Facebook page. She even wrote about Guerrero’s sexual orientation and outed him.

"This is completely private," he said. "It’s not anything I would ever in a million years post randomly. I’m the same as everyone else."

Derby also allegedly attacked Guerrero’s mother who was inside his apartment at the time of the incident. The authorities say that Guerrero has bruises on his throat and body, which is enough proof that Derby attacked him.

The police also say that Derby used a homophobic epithet to describe the victim to investigators.

"This is a hate crime due to the statements the arrested person, Mrs. Derby, made to the officers on the scene," Richland Hills Detective Tye Bell said.

Derby has been charged with assault and aggravated assault with a deadly weapon enhanced as a hate crime.

"The charges are serious," Bell said. "First-degree felony is as high as you can go."

Guerrero believes she attacked him out of hate and agrees with the charges.

"I don’t want anybody to do that and get away with it," Guerrero said.

No matter what age, hate is never an excuse. She better get convicted! Deterrence is the best form of impact.

shes 71 and set in her ways. I could never bring myself to tell my grandmother Im gay. I feel bad for guerrero and the old lady. I dont believe that behind bars is the answer. I think probation and maybe picking up trash in the community would be better. Shes worked her entire life and shouldnt be in prison where she may loose everything she has earned for 71 years. Put her on house arrest.

She almost killed the guy. She needs to be punished and off the streets. Idc how old and what she did in her life to this point.

Maybe taking an educational course as a condition of her probation, as well as anger management. I agree that prison probably isn’t the answer, but maybe 7-30 days jail time, followed by 5-10 years of house arrest/probation/parole, with said classes as condition. I think a lawsuit wouldn’t hurt either. I’ve heard of a family of the victim of a drunk driver asking that perpetrator to pay them $1 a day for the length of his probation. However, they’d only accept a check and he had to send one separately every day. That way, he’d be reminded once a day of what he did to their son.

I don’t think her age should be a factor in any punishment. At 71yo she knows right from wrong. Assaulting anyone is a crime and should be punished as such. Now ADW (assault with a deadly weapon) might be stretching it. But assault with a hate crime, no problem. Put her butt in jail and let her serve her time just like anyone else.

She doesnt deserve a prison sentence. maybe a few days to scare her..

Are some of you saying a few days for real. How about If she killed him. Would you still say granny is just set in her ways. Charles manson was set in his ways too. A law is a law. And granny can’t break them either without the punishment.

Lock the hag up and throw away the key.

Agreed with everyone advocating her being locked up. She is obviously a danger to others. She tried to choke him for God’s sake. That’s unacceptable.

They should bring back the stocks and public flogging just for this old bag. She isn’t fit to appear in decent society. She did the crime now let her do the time.

At the age of 71, she should be mellow and content with life without attacking someone because she doesn’t believe in a life style. She committed a hate crime, and they are all the same, not one is different than the other, and her age makes it no different. her reasons were selfish, and unmoral.
